The Alpine City Land Use Hearing Officers, as the Appeal Authority, shall act in a quasi-judicial manner to:
(1) hear and decide variances from the terms of the land use ordinances;
(2) hear and decide appeals from decisions granting or denying resonable accomodations for persons with disabilities from land use regulations; and
(3) hear and decide appeals from land use decisions applying or interpreting the land use ordinances.
The Alpine Hearing Officers shall be appointed by the Mayor with the advice and consent of the City Council. The individual appointed as Hearing Officer shall be a person who is trained in or familiar with the disciplines of planning or law.
Any person or entity desiring a waiver or modification of the requirements of a land use ordinance may apply to the Hearing Officer for a variance from the terms of the ordinance. For example, a person may want to build a structure closer to his property line than allowed by the land use ordinance. This person may apply to the Hearing Officer for a variance to build the structure closer to the property line. Variances are governed by state law which outlines the criteria that must be met for a variance to be granted. Variances run with the land. The Hearing Officer may not grant a use variance.
